1. Introduction

ThruDark Limited ("ThruDark", "we", "us", "our") welcomes content created by our community. This User-Generated Content Policy ("Policy") sets out the terms under which ThruDark may use photographs, videos, and other media ("Content") created and shared by members of the public ("you", "the Creator").

By participating in any of the submission methods described in this Policy, you confirm that you have read, understood, and agreed to its terms.

This Policy should be read alongside our Privacy Policy and Terms and Conditions, which are available on our website at www.thrudark.com.

2. Scope

This Policy applies to all Content submitted to or identified by ThruDark through the following channels:

• Use of the branded hashtag #thrudarkallies on any public social media platform;
• Content in which ThruDark's official social media accounts are tagged or mentioned;
• Direct submission via ThruDark's UGC Upload Page at https://www.thrudark.com/pages/in-the-field-submission.

3. How to Submit Content

3.1 Branded Hashtag: #thrudarkallies

By voluntarily including the hashtag #thrudarkallies in a post published on a public social media account, you are granting ThruDark a licence to use that Content in accordance with Section 5 of this Policy. No further action is required on your part.

The hashtag must be included in your original post. Adding it after the fact to a post that has already been flagged for review does not retroactively constitute permission.

3.2 Tagged Content

If you tag ThruDark's official social media accounts in a piece of Content but do not include the #thrudarkallies hashtag, a member of the ThruDark team may comment on your post to request permission to feature your Content on our channels.

• Permission will only be considered granted if you respond to that comment with the hashtag #yes.
• Responding with any other phrase, emoji, or informal confirmation does not constitute permission.
• Silence, a 'like', or a private message does not constitute permission.
• ThruDark will not use tagged Content under this mechanism without an explicit #yes response.

Your account must be public at the time of your response and at the time any Content is accessed for use.

3.3 UGC Upload Page

You may submit Content directly to ThruDark via our dedicated upload page at https://www.thrudark.com/pages/in-the-field-submission. To do so, you must:

• Provide a valid email address;
• Upload your Content in an accepted format (see Section 3.4);
• Click Submit to confirm your submission and acceptance of this Policy.

By submitting Content via the upload page, you are granting ThruDark a licence to use that Content in accordance with Section 5. Attribution for Content submitted via this method is not guaranteed (see Section 6).

3.4 Accepted Formats

• Images: JPG, PNG, WEBP
• Videos: MP4, MOV

4. Eligibility

To submit Content, you must:

1. Be aged 18 or over. By submitting Content, you confirm that you meet this requirement.
2. Be the original creator of the Content and hold all necessary rights to grant the licence described in Section 5.
3. Hold a public social media account (for hashtag and tagged content routes) or submit via the upload page.
4. Ensure ThruDark product is the primary item featured in the Content (see Section 7).

By submitting Content through any of the methods described in Section 3, you grant ThruDark a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, publish, display, distribute, adapt, and share your Content across any of our channels, including but not limited to:

• The ThruDark website (www.thrudark.com);
• The ThruDark shop application;
• The ThruDark app;
• Email marketing communications;
• ThruDark social media channels (including resharing or reposting);
• Any future channels as determined by ThruDark.

This licence includes the right to:

• Crop, resize, reformat, or technically adapt the Content to suit different platforms and formats;
• Overlay text, branding, or graphic elements on or adjacent to the Content;
• Feature the Content in a commercial or promotional context.

You retain ownership of your Content. The licence you grant does not transfer copyright to ThruDark.

6. Attribution

• Content submitted via the #thrudarkallies hashtag or via a #yes response will be credited to the original creator's social media handle where reasonably practicable. Attribution format and placement are at ThruDark's discretion and may vary by platform.
• Content submitted via the upload page will not be guaranteed attribution. ThruDark will make reasonable efforts to credit where possible, but this cannot be assured.
• ThruDark reserves the right to omit attribution in cases where the format or context of use does not allow for it.

7. Content Standards

All submitted Content must meet the following requirements. ThruDark reserves the right to decline any submission that does not comply.

7.1 Required Standards

• ThruDark kit must be the primary item featured in the Content. ThruDark products must be clearly identifiable and the focus of the image or video. Content in which ThruDark products are incidental, obscured, or a minor element will not be considered.
• Content must be your own original work. You must not submit Content created by a third party without their explicit permission.
• You must have the consent of any identifiable individuals who appear in the Content.

7.2 Prohibited Content

ThruDark will not use Content that:

• Contains offensive, discriminatory, defamatory, or harmful material of any kind;
• Depicts illegal activities;
• Violates the rights of any third party, including intellectual property rights or privacy rights;
• Features individuals who appear to be under the age of 18;
• Promotes a competitor brand as a primary or co-featured product;
• Is misleading, inaccurate, or misrepresents ThruDark's products.

8. Verification and Approval

Submitting Content through any method described in this Policy does not guarantee that the Content will be used by ThruDark. All Content is subject to review and approval by the ThruDark team before use.

Approval is at ThruDark's sole discretion. ThruDark is under no obligation to use any submitted Content, nor to provide a reason for declining to do so.

9. No Compensation

ThruDark does not provide any payment, discount, gift, or other form of compensation in exchange for the use of UGC under this Policy, unless a separate written agreement to that effect has been entered into. Participation in this programme does not create any commercial relationship, partnership, or employment relationship between you and ThruDark.

10. Withdrawal of Permission

You may withdraw your permission for ThruDark to use your Content at any time by contacting us at support@thrudark.com with the subject line "UGC Withdrawal Request". Please include:

• Your name and social media handle (if applicable);
• A description or link to the Content in question;
• The email address used at the time of submission (for upload page submissions).

ThruDark will action withdrawal requests within 14 days. Please note that Content already published or distributed prior to receipt of your withdrawal request may not be possible to fully retract from all channels immediately.

11. Your Representations and Warranties

By submitting Content, you represent and warrant that:

1. You are the original creator of the Content and own or control all rights necessary to grant the licence in Section 5;
2. The Content does not infringe any third-party intellectual property, privacy, or other legal rights;
3. Any individuals featured in the Content have given their informed consent to being photographed or filmed and to the potential use of that Content by ThruDark;
4. You are aged 18 or over;
5. The Content complies with the standards set out in Section 7;
6. You have not been paid or provided with any incentive by a third party to submit the Content.

12. Indemnity

You agree to indemnify, defend, and hold harmless ThruDark, its directors, employees, and agents from and against any claims, damages, losses, or expenses (including reasonable legal fees) arising out of or in connection with any breach of the representations and warranties set out in Section 11.

13. Data Protection

When you submit Content via the upload page, ThruDark will collect your email address for the purposes of managing your submission and communicating with you regarding its use. This data is processed in accordance with ThruDark's Privacy Policy.

Your data will not be used for marketing purposes without your separate consent. You may exercise your rights under UK GDPR (including the right to access, rectify, erase, or restrict processing of your personal data) by contacting our Data Protection team at ollie@thrudark.com.

Social media handles associated with hashtag or tagged submissions are retained solely to support attribution and withdrawal requests.

14. ThruDark's Rights

ThruDark reserves the right to:

• Decline to use any submitted Content without notice or explanation;
• Remove previously published Content at any time, at its sole discretion;
• Amend or update this Policy at any time. Updated versions will be published at https://www.thrudark.com/pages/terms-conditions and https://www.thrudark.com/pages/in-the-field-submission and will take effect immediately upon publication. Continued submission of Content following any update constitutes acceptance of the revised Policy.
